...another abuse of eminent domain, this time thanks to State Senator James Seward...
The attempt by the Town of Prattsburg NY to invoke eminent domain to aid private developers of wind power has been roundly criticized as an abuse of fundamental property rights. We now face another abuse of eminent domain, this time it appears thanks to State Senator James Seward. It is my understanding that he supported the "Oil, Gas and Solution Mining Law" of 2005 law establishing "compulsory integration." This allows drillers for natural gas to usurp the rights of landowners who have not signed gas development contracts but who are included in so-called "units" where 60 percent of the acerage has been brought under contract. In other words, gas developers can designate a district, and once they sign up 60 percent of the acerage in that district they are able to coerce remainder property owners to give up their gas on terms beyond their control.
